Oomomo is committed to protecting your privacy and safeguarding your personal, business and financial information. This Privacy Statement applies to Oomomo Canada Ltd. and their respective affiliates in Canada (collectively, "Oomomo", "we" or "our").

The purpose of this Privacy Statement is to inform you about the types of Personal Information, as defined below, that Oomomo collects, uses and discloses. It explains how we use and disclose that information, the choices you have regarding such use and disclosure, and how you may correct that information.

This Privacy Statement is designed to meet the standards prescribed by the Personal Information Protection and Electronic Documents Act and the regulations thereunder ("PIPEDA") as well as applicable provincial privacy legislation and regulations, including but not limited to, the Personal Information Protection Act (British Columbia), the Personal Information Protection Act (Alberta), the Personal Health Information Protection Act (Ontario) and An Act respecting the protection of personal information in the private sector (Quebec).

This Privacy Policy was last updated on the date noted at the top of this webpage and may be updated from time to time in the future. If we make material changes, we will post the updated Privacy Policy on this page and change the date at the top of this webpage. Your continued use of the website following posting of changes to these terms will mean you accept these changes.

1. What is Personal Information?

"Personal Information" is any information that is identifiable with you, as an individual. This information may include, but is not limited to, your mailing address, telephone number, email address, Internet Protocol (“IP”) address, age, gender, marital status, health information, financial status, credit card information and credit history. Personal Information, however, does not include your business title, business address or business telephone number in your capacity as an employee of an organization.

2. How do we collect your Personal Information?

We will always collect your Personal Information by fair and lawful means (for example, when you engage us to provide services, use the Oomomo website, or speak to an Oomomo representative). We collect Personal Information directly from you, or indirectly from third party sources as otherwise permitted by applicable law.

From time to time, you may voluntarily provide Oomomo with unsolicited Personal information (e.g. by providing information through the Oomomo websites). When you provide Oomomo with your personal information, you understand and agree to Oomomo’s collection, use, storage, disclosure and retention of your information in accordance with this Privacy Policy or as otherwise permitted by law.

If you send someone else a communication from our services (such as sending a gift or virtual gift card), we may collect information such as that person's name, telephone number, email, and/or shipping address for the purposes of facilitating the sending of the gift or virtual gift card.

With respect to our websites, Oomomo may use cookies, log files and web beacons to collect information regarding the use of the websites. Generally, this information is non-identifiable and would likely not be considered Personal Information.

Cookies: Cookies are small text files placed on your hard drive that assist us in providing a more customized website experience. For example, a cookie can be used to store registration information in an area of the site so that a user does not need to re-enter it on subsequent visits to that area. It is Oomomo’s policy to use cookies to make navigation of our websites easier for visitors and to facilitate efficient registration procedures. If you are concerned about cookies, most browsers permit individuals to decline cookies. In most cases, a visitor may refuse a cookie and still fully navigate our Web sites.

Log files: In order to properly manage our website, we may anonymously log information on our operational systems, and identify categories of visitors by items such as domains and browser types. These statistics are reported in the aggregate to our webmasters and are generally non-identifiable.

Web beacons: To gather visitor statistics and manage cookies, we use electronic images called a "single-pixel GIF" or "web beacon." Web beacons allow our third-party tracking tools to gather information such as the IP address of your computer, the time the material was viewed and the type of Internet browser used to access the page. This information is tracked on the third party tracking tools' servers and reported in aggregate to our webmasters. If you are concerned about the use of Web beacons you can turn off your browsers' cookies. This action will prevent Web beacons from tracking your specific activity; however, the Web beacon may still record a visit from your IP address.

Marketing Automation: In order to provide you with the most personalized experience and give you access to products and services that are most relevant to you, Oomomo uses marketing automation tools to deliver targeted marketing campaigns across multiple Oomomo platforms (e.g. via web, email, mobile, etc.) and create customer profiles by tracking your behavior and preferences while using Oomomo platforms. All of Oomomo’s electronic marketing activities are done in accordance with applicable legislation, including Canada’s Anti-Spam Legislation.

We do not intend for our websites or online services to be used by anyone under 13 years of age. If you are under 13 years of age, please do not use our services, and if you are over 13 years of age but under 18 years of age, you should use our services with the involvement and permission of a parent or legal guardian. If we learn that we have inadvertently collected the Personal Information of a child under 13 years of age, we will use reasonable efforts to delete that information from our systems (except to the extent that retention of the Personal Information is required or permitted by applicable law). 3. Where do we store your Personal Information?

We will store and process your Personal Information in Canada and other countries. The laws of other countries regarding the collection, use, disclosure, and retention of personal information may be different from the laws of Canada, and their laws may be different from the laws of your country. The disclosure of your information in accordance with this Privacy Policy may result in your Personal Information being transferred outside of Canada or your country.

4. How do we use your Personal Information?

We generally use your Personal Information for the following purposes (the "Purposes"):

• to protect the security or integrity of the Site and our business, such as by protecting against and preventing fraud, unauthorized transactions, claims and other liabilities, and managing risk exposure, including by identifying potential hackers and other unauthorized users. to determine your eligibility for a product, program or service;
• to comply with applicable legislation and regulatory requirements;
• to support investigation and law enforcement purposes; and
• such other uses as may be permitted or required by applicable law.

Please note that in accordance with Canada’s Anti-Spam Legislation, you can choose not to receive any electronic marketing communications from us by clicking the “Opt Out” function contained in all Oomomo electronic communications. You may choose not to receive any direct mail from us by contacting our Privacy Officer as indicated in the “Contact Us” section below

5. How do we share your Personal Information?

We will never sell or rent your Personal Information to third parties. We may share your Personal Information in the following circumstances:

Our Subsidiaries and Affiliates: We may share your Personal Information between Oomomo subsidiaries and affiliated companies for proper management, analysis and decision making, including decisions regarding the expansion and promotion of our product and service offering, order or customer request fulfillment, and for use by those companies for the other purposes described in this Privacy Policy.

Our Service Providers: We may share your Personal Information with service providers that provide us with support services, such as credit card processing, website hosting, email delivery, location mapping, postal mail processing and delivery, and analytics services. We require our service providers to refrain from using and disclosing your Personal Information except when they are performing work for us or when the disclosure of your Personal Information is required by law.

For Marketing Purpose: We may share your Personal Information with service providers to provide you with customized promotions and special offers. This can include sharing your Personal Information with social media platforms in order to develop customized advertising that offers you unique products and services. We also may share anonymous, aggregated statistics about your use of our websites and services with other companies.

When You Consent: We may share your Personal Information with other companies if you give us permission or direct us to share the information.

When It Does Not Identify You: We may share your Personal Information in a way that does not directly identify you. For example, we may combine information about you with information about other people and share the combined information in a way that does not link your information to you.

When You Post on Our Websites and Social Media Platform: If you post information on one of our social media platforms or websites, the information that you post may be seen by other visitors, including your post information and your user name.

Sale of Business: We may make disclosures of Personal Information to a potential acquirer in connection with a transaction involving the sale of some or all of the business of Oomomo or as otherwise permitted or required by law, in which case the use of your Personal Information by the new entity would continue to be limited by applicable law.

Legal Disclosures; Safety: We and our service providers may disclose the information we receive from and about you to comply with a legal obligation; to provide information to law enforcement and other governmental authorities in accordance with applicable law, and when we believe in good faith that the law requires or permits it. We also reserve the right to share information with legal authorities and other companies for fraud protection, debt collection and credit risk reduction, to detect any technical or security vulnerabilities, to enforce our Terms & Conditions or other applicable policies, or to otherwise protect the rights, property, safety, or security of third parties, users of our services, Oomomo, or the public.

We may send your Personal Information outside of the country for the purposes set out above, including for process and storage by service providers in connection with such purposes. The servers and databases in which information may be stored or processed by may be located in other jurisdictions outside the country from which you accessed our services and in a country where the data protection and other laws may differ from your country of residence. In the event Personal Information is transferred to other foreign jurisdictions, it will be subject to the laws of that jurisdiction and may be disclosed to or accessed by the courts, law enforcement and governmental authorities in accordance with those laws.

Our website may include links to third party websites that are not affiliated with Oomomo. These websites may send their own cookies to visitors, collect data or solicit your information. Clicking on those links or enabling those connections may allow third party to collect or share data about you. The privacy policies of these other websites may be very different from our policy. We are not responsible for the privacy practices of these other websites and cannot guarantee the security of any personal information you provide to or that is collected by such third party websites. You should inform yourself with the privacy policies (if any) of those third party websites.

6. When and how do we obtain your consent?

You may provide your express consent to us either orally, electronically or in writing. You may also consent to Oomomo’s collection, use and disclosure of Personal Information by voluntarily providing us with Personal Information through a clear, affirmative action (e.g. by submitting an information request, using our services, participating in a survey, etc.). We may also rely on your implied consent to the collection, use and disclosure of your Personal Information where implied consent is permitted under applicable law.

We will not, as a condition of the supply of our services or products, require you to consent to the collection, use, disclosure or protection of information beyond that which is required to fulfill the specified and legitimate purposes for which the information is being collected.

7. How long will we use, disclose or retain your Personal Information?

We may keep a record of your Personal Information, correspondence or comments in a file specific to you. We will use, disclose or retain your Personal Information for as long as necessary to fulfill the purposes for which that Personal Information was collected, or as permitted or required by law.

8. How can you access or correct your Personal Information?

If you have registered for an account, you may also view and update your account information by logging into the "Your Account" section of the website.

You may also request access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law, by writing to our Privacy Officer at the email or postal address provided in the "Contact Us" section below. Any such access request may be subject to a small statutory fee to meet our costs in providing you with details of the information we hold about you, where permitted by applicable law. We may request certain personal information for the purposes of verifying the identity of the individual seeking access to their personal information records.

9. How can you delete your account?

If you want to cancel or delete your account, you may do so in writing to our Privacy Officer at the email or postal address provided in the "Contact Us" section below. We will make every effort to promptly respond to your request. We will retain your information for as long as your account is active or as needed to provide you services, such as product returns or warranties. If you ask us to delete your account, we generally retain and use your account information only as long as necessary to fulfill a business or law enforcement need.

10. What safeguards have we implemented to protect your Personal Information?

We have implemented physical, organizational, contractual and technological security measures to protect your Personal Information from loss or theft, unauthorized access, disclosure, copying, use or modification. The only employees who are granted access to your Personal Information are those with a business 'need-to-know' or whose duties reasonably require such information. On the Oomomo websites, we use secure socket layer technology for the protection of credit card information submitted through web forms.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. While we strive to protect your Personal Information, Oomomo cannot warrant the security of any Personal Information you transmit to us or from our online services, and you do so at your own risk.
